MALAYSIA: Tax exemption for foreign income is conditional on having been taxed in offshore jurisdiction

The Malaysian government has clarified that the five-year tax exemption for individuals' foreign-sourced income, announced at the end of 2021, applies only where the offshore income has been subject to tax 'of a similar character to income tax' under the laws of the territory where the income arises. Dividends received by corporate entities from an overseas jurisdiction are exempt from tax if the corporation tax imposed in the jurisdiction is at least 15 per cent.
